Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Rajapakar P.S. Case No. 117 of 2022, registered for the offences punishable under Sections 25(1-b)a, 26 & 35 of Arms Act.

The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot. Nothing was recovered from his possession. One Guddu Kumar was arrested with a pistol and he furnished his confessional statement in

Patna High Court CR. MISC. No.52805 of 2022(2) dt.25-01-2023 2/2 which he has stated that he purchased that pistol from the petitioner. Except confessional statement of co-accused, there is nothing against the petitioner.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 117 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
