The petitioner apprehends his arrest in connection with Babubarhi P.S. Case No. 104 of 2013 registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that petitioner is ready and willing to keep the opposite party No. 2 with full dignity and honour and opposite party is also ready to live with the petitioner.
Considering the bona fide offer made by the petitioner , let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.31653 of 2015 (2) dt.14-08-2015 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Madhubani in connection with Babubarhi P.S. Case No. 104 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
However, it is made clear that, if any, untoward act shall happen in future so as to cause mental torture to the opposite party No. 2, it will be open for her to seek appropriate steps in accordance with law before the appropriate authority. (Anjana Mishra, J) Jagdish/- U T
