====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 19-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sessions Trial No.626 of 2016, arising out of Araria P.S. Case No.191 of 2016, registered under Sections 364/34 of the Indian Penal Code. The accusation is that the daughter of the informant had gone to cut the grass but she did not return. In course of her search, her blood stained Dupatta, a bag containing grass and her broken pearls chain were found in a wheat field. Earlier, the petitioner and two others, namely, Talim alias Talib and Sarwar had given threatening to the informant for kidnapping of her daughter.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.1747 of 2017 (2) dt.19-01-2017 2/2 submits that the petitioner has falsely been implicated in this case on mere suspicion. Further submission is that the similarly situated co-accused Talim alias Talib and Sarwar have already been granted bail by a coordinate Bench of this Court vide order dated 05.09.2016 passed in Criminal Misc. No.29392 of 2016. The petitioner having no criminal antecedent is in custody since 23.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Incharge 2nd Additional Sessions Judge, Araria, in connection with Sessions Trial No.626 of 2016, arising out of Araria P.S. Case No.191 of 2016.
