Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201 of the Indian Penal Code.
As per the prosecution case, the informant got information that some unknown miscreants committed the murder of her husband and on such information she went there and found dead body of her husband with injuries on his neck and face.
Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner
Patna High Court CR. MISC. No.62935 of 2021(2) dt.18-02-2022 2/2 has transpired in this case during the course of investigation in the confessional statement of co-accused, Renu Devi, mother of the deceased. It is further submitted that even in the confessional statement of co-accused, Renu Devi, petitioner is alleged to be one of the conspirators and except the confessional statement there is no other material to suggest the complicity of this petitioner in the aforesaid crime. Petitioner is in custody since 13.02.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Barh, Patna in connection with Bakhtiyarpur PS case No. 182/2018.
