The following reliefs have been sought for by the petitioner in the present writ application.
"1. That the petitioner prays for issuance of a writ in the nature of mandamus commanding and directing upon the respondents concerned to consider the claim of petitioner for appointment on compassionate ground on any suitable post as the father of petitioner died in harness on 28.01.2004 working as Assistant Teacher in Primary School, Harna Hindi, under Block-Jhajha, DistrictJamui and mother of petitioner submitted application for providing
Patna High Court CWJC No.6603 of 2014 (4) dt.27-11-2017 2/3 appointment on compassionate ground before respondent then District Superintendent of Education (now re-designated as District Programme Officer (Establishment) on 18.05.2004 but claim of petitioner was kept in abeyance as death-cumretirement benefit of deceased employee was not paid but now in view of order passed by this Hon'ble Court in C.W.J.C. No. 11144/2011 disposed of vide order dated 01.05.2013 death-cum-retirement benefit has been finalized and mother of petitioner has been paid family pension and as such now there is no legal embargo to consider the claim of compassionate appointment of the petitioner."
It has further been submitted by learned counsel for the petitioner that during pendency of the present writ application, the petitioner has been appointed on the post of Block Teacher vide Memo No. 06 (Headquarters) dated 22.01.2016. The case of the petitioner is squarely covered by the order passed by Hon'ble Supreme Court in Civil Appeal Nos. 4776-4777 of 2017 dated 03.04.2017.
Considering the submissions made on behalf of the petitioner, the present writ application stands disposed of in terms of the order passed by Hon'ble Supreme Court in Civil Appeal Nos. 4776-4777 of 2017 dated 03.04.2017.
The respondents shall examine the case of the
Patna High Court CWJC No.6603 of 2014 (4) dt.27-11-2017 3/3 petitioner in light of the aforesaid order passed by Hon'ble Supreme Court and if the case of the petitioner is found identical then pass an appropriate order in accordance with law within the reasonable period.
