This is a petition for grant of regular bail for offence under Sections 302, 307, 354(B) and 34 of the Indian Penal Code and 27 of the Arms Act.
For land dispute there is allegation that co-accused, Sadanand Mandal, conspired and Sadanand Mandal, along with two named criminal associates, intercepted the informant and her husband on the say and they fired causing injury to both the person, as a result whereof husband of the informant died. Submission of the petitioner is that the petitioner is not named in the first information report. Informant is the eye witness of the occurrence. Petitioner was not present at the place of occurrence, however, his name has transpired in the confessional statement of the petitioner himself. Considering the aforesaid material, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bariyarpur P.S. Case No. 33 of 2016 to the satisfaction of the Chief Judicial Magistrate, Munger, or successor Court.
