Petitioner is apprehending his arrest in connection with Singhia. P.S. Case No. 38 of 2019 for the offences registered under Section 120(B), 201, 302, 376(A), 376(D) of the Indian Penal Code and Section 4 & 6 of the POCSO Act. Informant has alleged in his written complaint that on 05.05.2019 petitioner along with FIR name co-accused took her minor daughter and committed rape with her and thereafter killed her by pressing her neck with scarf and burnt her with bamboo leaves.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case

Patna High Court CR. MISC. No.49107 of 2019(3) dt.16-11-2019 2/2 due to malafide intention of the informant. Petitioner has no criminal antecedent.

In the facts and circumstances as stated above, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected.
