JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-01-2022 Heard Mr. Rameshwar Singh, the learned counsel for the petitioner and Mr. J.P. Singh, the learned counsel for the opposite party no. 2. The State is represented by the learned APP.

The petitioner, who is husband of opposite party no. 2 seeks bail in anticipation of his arrest in connection with Kargahar P.S. Case No. 06 of 2020 instituted for the offences under Sections 341, 323, 498(A), 494, 504, 506 and 34 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

No.12225 of 2021(3) dt.03-01-2022 2/2 Without referring to the factual aspects of this case, the learned counsel for the parties have intimated this Court that both the spouses have now married different persons and are satisfactorily living with their new spouses. Considering this aspect of the matter, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Kargahar P.S. Case No. 06 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
