The petitioner seeks bail in Maker Police Station Case No. 111 of 2016, registered for the offences punishable under Sections 420, 406 and 409 of the Indian Penal Code. The petitioner was posted as Jansewak in the block office of Maker block in the district Saran during the period of 2002-02 and 2003-04. In that capacity, he was appointed as agent to execute certain work. Allegedly, the petitioner was given money and rice for executing the work in relation to two different projects. It is alleged in the first information report that the petitioner did not get the work completed in one of the projects and in respect of other, it is alleged that he did not place any notice board in respect of construction of a road and,

Learned counsel appearing on behalf of the petitioner appears to be correct in her submission that the first information report suffers from vagueness. She has also submitted that since the petitioner is a Government employee, there is no chance of fleeing from the course of investigation or trial. Considering the above submissions, this application is allowed.

Let the petitioner, Kedar Nath Ram, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Saran in Maker Police Station Case No. 111 of 2016.
