This is an application for grant of regular bail for offences punishable under Sections 385 and 387 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case by the informant and so far as the recovery of the mobile was concerned, it was not the same mobile from which the calls used to be made. Learned counsel for the petitioner further submitted that as regards the criminal antecedents, the petitioner has been enlarged on bail in all other cases, except present one.
Learned Additional Public Prosecutor for the State has submitted that the petitioner has criminal antecedents and he is
Patna High Court Cr.Misc. No.54772 of 2016 (2) dt.20-12-2016 2/2 alleged to be involved in as many as nine cases and the mobile from which, the petitioner used to threaten the informant. Considering the facts and circumstances of the case and the petitioner having criminal antecedents in several cases, I am not inclined to grant the petitioner, the privilege of regular bail at least at this stage, it is, accordingly, rejected. However, the petitioner may renew his prayer for bail after six months from today.
