JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor.

The application is for grant of bail in connection with Laxamipur PS case no. 12 of 2015 for the offence under Sections 307, 353 and other sections of the Indian Penal Code and various sections of Arms Act.

It is submitted on behalf of petitioner that he has been named in FIR at the instance of other co-accused who has been apprehended at the spot and there is also no recovery from the petitioner and petitioner is in custody since 23.06.2015. Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.

Having heard both sides. It appears that there is

Patna High Court Cr.Misc. No.798 of 2017 (2) dt.17-01-2017 2/2 no recovery from possession of petitioner and he has been named in this case at the instance of other co-accused. No doubt from perusal of petition, it appears that petitioner is accused in 14 other cases but learned counsel submitted that in all that cases, he is on bail. As such, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Rs. Fifty thousand) with two sureties of the like amount each to the satisfaction of A.D.J.II, Jamui in connection with Laxmipur P.S. case no. 12 of 2015 with a condition that bailors should have the property within the jurisdiction of learned court below with further condition that he will cooperate in the disposal of the case and his failure to attend the court on two consecutive dates will liable for cancellation of his bail bonds with further condition that if he be made accused in any case in future, prosecution is free to move for cancellation of bail bonds.
