JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The offence relates to murder of unknown person. The F.I.R. is against unknown.
Submission is that during investigation no eyewitness has supported the occurrence; rather in the confessional statement of the co-accused name of the petitioner has transpired.
Learned Additional Public Prosecutor after perusal of the case-diary does not dispute the aforesaid contention. Considering the facts aforesaid, let petitioner,
Patna High Court Cr.Misc. No.42425 of 2016 (3) dt.21-12-2016 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan/Successor Court, in connection with Ander P.S. Case No. 29 of 2016.
