The Petitioner seeks regular bail in connection with Khutauna P.S.Case No. 67 of 2018, G.R. No. 771 of 2018, registered for offences punishable under Sections 399, 402, 414, 506, 120B of the Indian Penal Code and Section 25 (1-b) A/26/35 of the Arms Act.
Allegation against the petitioner as per F.I.R. is that the petitioners along with others were apprehended at the spot and one loaded country made pistol has been recovered from the possession of one co-accused, Amrit Kumar @ Gopi. Submission of the learned counsel for the petitioner is that the petitioner has been arrested on the spot but nothing has been recovered from the conscious possession of the petitioner and the petitioner has no criminal antecedent and the petitioner is in
Patna High Court Cr.Misc. No.61782 of 2018 (2) dt.11-10-2018 2/2 custody since 12.06.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Jhanjharpur, District Madhubani in connection with Khutauna P. S. Case No. 67 of 2018, G.R. No. 771 of 2018, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
