17-02-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Bariarpur P.S. Case No. 68 of 2021, registered for the offence under Section 302 of the Indian Penal Code and Section 27 of the Arms Act. As per the F.I.R., on 10.06.2021 at about 8.30 AM, co-accused Sanjiv Kumar Mandal, Chhotu Kumar and Devraj Kumar Yadav shot dead the son of informant. The informant has raised suspicion that by hatching a conspiracy, this petitioner hired the criminals and got his son killed due to old enmity. It is submitted on behalf of petitioner that as per First Information Report, specific allegation of firing is against other co-accused persons and petitioner is only alleged to be conspirator. Neither any overt act has been alleged against this

Patna High Court CR. MISC. No.62265 of 2021(2) dt.17-02-2022 2/2 petitioner nor he was seen at the place of occurrence. Petitioner has got clean antecedent and he is in custody since 11.06.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Munger / concerned court in connection with Bariarpur P.S. Case No. 68 of 2021.
