2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 323, 324, 307, 354, 379, 386, 504 and 506/34 of the Indian Penal Code, registered in connection with Jadia P.S. Case No. 258 of 2023.
3. As per prosecution case, the accused persons including the petitioner entered into house of the informant. It is further alleged that the specific allegation against the petitioner is that he assaulted the brother of the informant by means of Dabiya due to which he sustained injury.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.54948 of 2024(2) dt.19-08-2024 2/2 that he has been falsely implicated in this case and has committed no offence. He submitted that both the parties are agnates and only one injury is found upon the informant's brother which is grievous in nature. Petitioner is in custody since 14.10.2023.
5. Learned APP for the State has opposed the prayer of bail.
6. Considering the above facts and circumstances of the case as well as period of custody, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Jadia P.S. Case No. 258 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
