The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.
The informant a police constable alleged that while he was going to his duty the petitioner and other accused persons were making hue and cry. When the informant asked them to go, the petitioner and others assaulted the informant and also snatched his service revolver.
It is submitted that the story is quite different. The informant himself was drunken condition and he misbehaved and passed comments on a girl who was passing through the road. The petitioner and others objected the misdeeds of the informant. The
Patna High Court Cr.Misc. No.27790 of 2015 (2) dt.23-07-2015 2/2 victim Pooja Kumari also filed petition before the Chairman of Women Commission.
Having considered the facts that the petitioner and others assaulted the informant and snatched his service revolver, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
