JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered under sections 307/34 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that under order of this petitioner coaccused Bijay Yadav caused fire arm injury on the chest of the informant. Thereafter, the petitioner and co-accused assaulted the younger brother of the informant, namely, Rajo Yadav It is submitted by the learned counsel for the petitioner that the accusation of causing fire arm injury is against Bijay Yadav, whereas the injury report of Rajo Yadav suggests one simple and superficial injury, though the allegation of assault is against the petitioner and one co-accused Pawan

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 455/14, subject to the conditions as laid down under section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) B.Roy/- U T
