JUSTICE RAVI RANJAN ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences under Section 392/34 of the Indian Penal Code. It is contended that, as per allegation, the informant is the manager of Bharat Financial Inclusion Limited and on 22.03.2018 at 12 O' clock in day he went Dhudhuldih from his village by motorcycle when he reached at road of Patalghata village then the miscreants have looted motorcycle, Rs. 75069/- of collection and Rs. 3610/- from purse of his pocket, tab Biomatics, Samsung mobile and ATM Card.
It is contended that the petitioner was not named in the First Information Report but only on the basis of confessional statement of co-accused Pawan Tanti he has been implicated in this case. It is further contended that there is no
Patna High Court Cr.Misc. No.62700 of 2018(2) dt.08-10-2018 2/2 recovery of any incriminating material from his possession. The petitioner has been remanded in this case from another case on 07.06.2018, however, without any material against him having been collected during course of investigation save and except the confessional statement of co-accused person. It is urged that the petitioner is in custody since 07.06.2018. Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned J.M. 1st Class, Jamui or its successor in connection with Laxmipur P.S. Case No. 100 of 2018.
