The petitioner has prayed for bail in connection with Adhoura P.S. Case No. 21 of 2022 instituted for the offence under Sections 302/34 of the Indian Penal Code. The allegation against the petitioner is that when the husband of the informant went to house of one Yamuni Kuwer, the petitioner along with other co-accused persons assaulted to the informant's husband by means of lathi danda due to which he sustained injury thereafter he was being taken to hospital for treatment but in the way, he died.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted that

Learned APP appearing for the state has vehemently opposed the prayer of regular bail and submitted that the direct allegation of assaulting to the informant's husband is against the petitioner and doctor also opined that deceased sustained injuries on the parietal region of his head and due to which he succumbed to injury. Postmortem report and witnesses also corroborates the prosecution case.

Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial Court is directed to expedite the trial and conclude the same as soon as possible.
