The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 497, 457, 380 and 379 of the Indian Penal Code.
The prosecution case is that the petitioner being neighbor of the informant entered into the house of the informant and ravished her when mother of the informant came to rescue she was also assaulted. The petitioner took cash of Rs.20,000/- and jewellaries.
It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has
Patna High Court Cr.Misc. No.26839 of 2015 (2) dt.21-07-2015 2/2 been brought on record as annexure-2 to the petition. The doctor assessed the age of the victim below 19 years and found no mark of violence suggesting the accusation of rape. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bounsi P.S. Case No.86 of 2013, pending before the learned Judicial Magistrate, 1st Class, Araria.
With the above observation, this application is, accordingly, disposed off.
