JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2018 The petitioner is in custody since 30.06.2018 in connection with Chhauradano P.S. Case No. 176 of 2018, registered for offences punishable under Sections 341, 323, 354(B), 379, 34, 384 of the Indian Penal Code, Section 8/12 of POCSO Act and Section 67 of Information Technology Act. Allegation against the petitioner and other accused persons is of harassing the daughter of the informant and also taking her towards the jungle.
Submission of learned counsel for the petitioner is that the specific allegation of molesting is against other accused persons and there is general allegation against the petitioner, having no criminal antecedent and he is in custody since

Having heard both sides and considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge Cum Special Judge, Motihari, District-East Champaran, in connection with Chhauradano P.S. Case No. 176 of 2018, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing
