JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 273 of the Indian Penal Code and Section 47 of Excise Act.

From the shop of the petitioner illegal country-made and foreign liquor were recovered.

It is submitted by the learned counsel for the petitioner that the FIR was lodged on 21.04.2015 but it reached to the court of learned S.D.J.M. on 24.04.2015 which suggests that the FIR has been ante-dated. Statement has been made in paragraph 3 of the application that petitioner has got no criminal antecedent. The aforesaid facts constitute grounds for consideration

Patna High Court Cr.Misc. No.28373 of 2015 (2) dt.23-07-2015 2/2 of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Ramnagar P.S. case No. 74/15 pending in the court of learned SDJM, Bettiah, West Champaran. This application is disposed of with the aforesaid observation/direction.
