2. The present Criminal Miscellaneous Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioner who apprehends his arrest in connection with Piprahi P.S. Case No. 53 of 2025, for the offences punishable under Sections 108 and 3(5) of the BNS, 2023.

As per the prosecution, FIR has been lodged against two accused persons excluding the present petitioner against whom there is allegation made by the informant that her daugher was a student of Sheohar Engineering College and she was subject to suicide and threat was also given by the faculty to

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that petitioner is not named in the FIR and his name has been dragged in this case by Investigating Officer due to the reason that CDR report of the mobile indicates that the petitioner was in continuous contact with the deceased.

5. Counsel further submits that the petitioner is a mess incharge and deceased used to contact him for mess food and so far as intimacy is concerned, he has completely denied. He further submits that the deceased got failed in subject and it is due to this reason, she has committed suicide. He further submits that the petitioner has unnecessarily been made accused in this case.

6. Counsel submits that the criminal antecedent of the petitioner is not clean as there are two criminal cases pending against him in which he is on bail.

7. Learned counsel for the informant vehemently opposes the prayer for bail and submits that mobile of the deceased has been recovered in course of the investigation and from the case diary, it is also clear that the petitioner and the deceased are in contact with mobile.

8. Learned APP for the State opposes the prayer for bail of the petitioner and submits that petitioner's antecedent is not clean and they are in contact with each other.

9. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of J.M.-1st, Sheohar in connection with Piprahi P.S. Case No. 53 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
