The petitioners apprehend their arrest in registered for the offences punishable under Sections 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant named 13 persons including the petitioners and alleged that they having armed with different weapons came and began to assault the informant and his family members. Tanveer is alleged to have fired. Rakim has assaulted Md. Parvez with Pharsa. Md. Mobin is alleged to have snatched money. Gufran and Rukhsana also assaulted the informant and his family members.
Patna High Court Cr.Misc. No.26933 of 2015 (2) dt.22-07-2015 2/2 It is submitted that there is counter version being Jokihat P.S. Case No. 16 of 2014. The informant Md. Salimuddin and his family members were injured. They were taken to Sadar Hospital, Purnia where his statement was recorded. It is further submitted that all the injured got simple injuries. Similarly, situated co-accused Sarmad @ Sarmad Alam has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 16463 of 2015. The case of the petitioners stands on similar footing.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Araria in Jokihat P.S. Case No. 360 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
