It is submitted by learned counsel for the petitioner that the order dated 02.02.2021 passed in this case has been complied with and a supplementary affidavit has been filed. This application has been filed for modification of the order dated 20.7.2020 passed in Cr. Misc. No. 18809/2020 whereby while directing the petitioner to be enlarged on anticipatory bail, it was directed that the petitioner shall surrender in the court below in connection with Excise Case No. 25 of 2020 within a period of eight weeks. The petitioner wants modification of the said order and extension of time granted in the above mentioned order dated 20.7.2020 to enable the
Patna High Court CR. MISC. No.4390 of 2021(3) dt.03-03-2021 2/2 petitioner to surrender in the learned court below. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the contents of the supplementary affidavit filed, the Court is inclined to allow the instant modification application. The order dated 20.7.2020 passed in Cr. Misc. No. 18809/2020 is modified to the extent that the time/period granted to the petitioner to surrender in the court below is extended by a further period of 8 weeks from today. On his so surrendering, the petitioner shall be enlarged on bail in connection with Excise Case No. 25 of 2020 pending in the court of learned Special Judge, Excise, Gaya.
Remaining part of the order dated 20.7.2020 passed in Cr. Misc. No. 18809/2020 shall remain the same. The application stands allowed to the above extent. (Partha Sarthy, J) Spd/- U T
