The petitioners are apprehending their arrest in connection with Hussainganj P.S. Case No. 320/2014 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379 of the Indian Penal Code.
Learned counsel for the petitioners submits that earlier there was land dispute between the parties and due to this the instant case has been lodged. It has also been submitted that both parties started fighting and a counter case was also lodged bearing Hussainganj P.S. Case No. 321/2014 on the same date i.e. on 18.12.2014.
Considering the aforementioned facts and nature of
Patna High Court Cr.Misc. No.30129 of 2015 (2) dt.04-08-2015 2/2 allegation and that there was altercation on account of the land dispute and also the fact that the petitioners have no criminal antecedent, let the above named petitioners, in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Hussainganj P. S. Case No. 320/2014, subject to condition as laid down under Section 438( 2) of Cr. P.C. (Anjana Mishra, J) Sudha/- U T
