Petitioner seeks bail in a case registered under sections 379 and 411 of the Indian Penal Code.

Taking into consideration that petitioner was caught on the spot with stolen trolley, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Katihar Rail P.S. Case no. 33/2016 pending in the court of the Railway Judicial Magistrate, Katihar stands rejected. However, this order shall not cause any cloud on the observation given by learned Sessions Judge and the petitioner shall be at liberty to renew his prayer for bail in the light of observation as given by learned Sessions Judge in the impugned order dated 20.7.2016.
