Petitioner seeks bail in Kessariya P.S. Case No.350 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Counsel for the petitioner submits that from the seizure list it does not appear that alleged illicit liquor was recovered from conscious possession of the petitioner. Petitioner is said to be in custody since 31.08.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above

Patna High Court Cr.Misc. No.62639 of 2018 (2) dt.09-10-2018 2/2 named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, East Champaran, Motihari, in connection with Kessariya P.S. Case No.350 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
