The grievance of the petitioner in the present writ application is non-payment of salary for the period December, 2011 to April, 2012.
Learned counsel appearing on behalf of the respondent referring to para-5 of the counter affidavit submits that fund has been released by the State Government for payment of salary to the petitioner vide Cheque No. 000196
Patna High Court CWJC No.15326 of 2014(2) dt.03-08-2018 2/2 dated 29.12.2014 Learned counsel for the petitioner submits that till date petitioner has not received the payment. In view of the above, the writ petition is disposed of with direction to the respondent District Programme Officer (Establishment) to see that payment must reach the petitioner within a period of sixty days from the date of receipt/production of a copy of this order.
In the event the petitioner is not paid salary by the Panchayat Shachiv and Headmaster of the school, it shall be the obligation of the District Programme Officer to report the lapse of the erring person to the District Magistrate, Bhagalpur who shall take all coercive steps against the Panchayat Secretary and all concerned for ensuring payment of salary to the petitioner. With the aforesaid, the writ petition stands disposed of.
