The petitioner is apprehending his arrest in connection with Bhagwanpur P.S. Case No. 46 of 2015 for the offences instituted under Section 306/34 of the IPC.

The prosecution story, in brief, is that the petitioner assaulted the deceased Md. Anwar by means of fists-slaps and thereafter the deceased entered inside the house and administered himself some poisonous substances and due to which he died. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. It is further submitted that the deceased has taken loan from the petitioner as he was not

Patna High Court Cr.Misc. No.27101 of 2015 (3) dt.09-09-2015 2/2 being able to pay back the money he has committed suicide after quarrelling with his wife. There is no specific role alleged against the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Bhagwanpur P.S. Case No. 46 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
