The petitioner apprehends his arrest in connection with Aahiyapur P.S. Case No.538 of 2018 registered under Sections 363 and 366(A) of the Indian Penal Code. The accusation is of kidnapping the daughter of the informant by Bablu Kumar, the son of the petitioner, with an intention to perform the marriage. Bablu Kumar also used to give threatening to the informant to kill him and his family, if the case is lodged.
Learned counsel for the petitioner submits that, in fact, due to love affair, the daughter of the informant, whose age has been assessed in between 18-19 years in medical
Patna High Court CR. MISC. No.49638 of 2019(2) dt.08-08-2019 2/2 examination, left her house with Bablu Kumar, the son of the petitioner, but with an ulterior motive, the petitioner has falsely been implicated in this case.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Aahiyapur P.S. Case No.538 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
