JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with specific allegation that he assaulted the informant as well as deceased by means of garasa. The present case was lodged in the year 2003 but petitioner could be remanded in this case on 08.01.2013 that is after 10 years of the alleged occurrence. The trial court has reported that up till now charge could not be framed against the petitioner.
Regard being had to the facts and circumstances as well as submission of the parties, the prayer for bail of the petitioner in connection with Session trial no. 487 of 2016 arising out of Bachhwara P.S.Case No. 66 of 2003, pending in the court
Patna High Court Cr.Misc. No.38787 of 2016 (3) dt.17-11-2016 2/2 of Additional Sessions Judge- VI, Begusarai stands rejected. However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible because petitioner is in jail custody since 08.01.2013 without substantial progress in his trial.
