The petitioners apprehend their arrest in Chapra Muffasil P.S. Case No. 57 of 2015, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The informant named the petitioners and alleged that they entered into his house and abused him and on protest they assaulted him and his family members.
It is submitted that the occurrence took place on 27.03.2015 but the fardbeyan was given on 29.03.2015. On the
Patna High Court Cr.Misc. No.27060 of 2015 (2) dt.20-07-2015 2/2 same date i.e. on 27.03.2015 Munna Prasad (Petitioner no. 4) was brutally assaulted by Yogendra Prasad (the informant) and others for which Chapra Muffasil P.S. Case No. 60/2015 was lodged. Petitioners are co-sharers and neighbours of the informant. Yogendra Yadav got one lacerated wound which is simple in nature.
Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 57 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
