The petitioner is accused in connection with Sherghati (Dobhi) P.S. Case No. 480 of 2018 registered under Sections 272, 273 and 414/34 of the Indian Penal Code and Sections 33 and 30(A) of the Bihar Excise Act. The accusation is of recovery of 9 Gallon spirit each containing 40 litres from the vehicle bearing registration no. JH OLD-3000, which was being driven by the petitioner, who also disclosed that one person, namely, Pintu Kumar, also sitting in the said vehicle, succeeded to flee away.
Learned counsel for the petitioner submits that, in fact, petitioner is only the driver of the vehicle and Pintu Kumar,
Patna High Court Cr.Misc. No.62292 of 2018(2) dt.06-10-2018 2/2 owner of the vehicle, was also sitting in the vehicle, in which, 9 Gallon spirit each containing 40 litres was recovered. It is further submitted that petitioner has no criminal antecedent and is in custody since 27.08.2018.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Gaya, in connection with Sherghati (Dobhi) P.S. Case No. 480 of 2018, Out of two sureties, one surety must be the close relative of the petitioner.
