The petitioner is apprehending his arrest in connection with Kako P.S. Case No. 187/2014 for the offences instituted under Sections 341, 324, 326, 307 and 504/34 of the IPC. The prosecution story, in brief, is that on 30.10.2014 at about 2-3 P.M., while the informant's mother was cutting grass in her field, in the meantime, the petitioner alongwith co-accused persons came there and some altercation took place with regard to throw some thrones of Babul trees and on her protest, they have mercilessly assaulted to the informant's mother who was also assaulted with sickle on her cheek, eye, palm, ear and neck by coaccused Mithilesh Manjhi. Patna High Court Cr.Misc. No.27059 of 2015 (3) dt.09-09-2015 2/2 treatment at Sadar Hospital, Jehanabad, from where she was referred to P.M.C.H., Patna, for better treatment. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the general and omnibus allegation has been made against the petitioner and other co-accused for assaulting the mother of the informant. It is further submitted that no specific injury has been attributed against the petitioner.

On behalf of the State it has been submitted that from perusal of the injury report, it appears that some of the injuries are grievous in nature.

Considering the aforesaid facts and circumstance, I am not inclined to grant anticipatory bail to the petitioner in connection with Kako P.S. Case No. 187/2014, pending in the court of the learned A.C.J.M., Jehanabad. The same is rejected. Anyhow, if the petitioner surrenders in the court below within a period of six weeks from the date of receipt/production of copy of this order the same shall be considered on its own merit without being prejudiced by this order preferably on the same day.
