The application is for grant of bail for the offence under Sections 47 (A) and 47 (E) of the Excise Amendment Act, 2016.

Allegation against the petitioner is said to be recovery of 5 litres of country made liquour. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent and he is in custody since 26.09.2016.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that recovery is said to be 5 litres only and the petitioner is in custody

Patna High Court Cr.Misc. No.54981 of 2016 (2) dt.22-12-2016 2/2 for sufficient period and he has no criminal antecedent, let petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Complaint Case No. C-102 (7) of 2016, Murliganj.
