The petitioner is apprehending his arrest in connection with Goraul P.S. Case No. 215 of 2014 for the offences instituted under Section 379 of the IPC.

The prosecution story, in brief, is that the informant works as Area Head in Sahara Que Shop and said Sahara Que Shop used to get the quality Van plied in order to make the people aware about the range and the petitioner was deputed as cashier. It is alleged that the record of transaction had to deposit in the head office, Goraul, but the petitioner fled away with the billing machine and cash Rs. 1,12,147/-. The informant made search but could not get any trace.

Patna High Court Cr.Misc. No.27126 of 2015 (3) dt.09-09-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the alleged date of occurrence is 13.06.2014 but the present case was instituted on 04.08.2014. No explanation has been made on behalf of the prosecution in this respect to delay in institution of the case. The petitioner has falsely been implicated in the present case.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Goraul P.S. Case No. 215 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
