The issue raised in the present writ application is no more res integra. This Court has occasion to decide the similar issue in C.W.J.C. No. 6139 of 2007 dated 31.03.2011, which was affirmed by the LPA Court in L.P.A. No. 756 of 2015 vide order dated 16.08.2017.

Considering the aforesaid, the writ application is disposed of with a direction to the District Education Officer, Lakhisarai (respondent no.3) to examine the case of the petitioners in the light of the aforesaid judgments and grant similar benefits to these petitioners on the line of the decision passed in C.W.J.C. No. 6139 of 2007 and L.P.A. No. 756 of 2015, if the case of the case of these petitioners are similar to that of C.W.J.C. No. 6139 of 2007 and L.P.A. No. 756 of 2015. Necessary decision in this regard must be taken by the respondent District Education Officer, Lakhisarai within a maximum period of 60 days from the date of receipt/production of a copy of this order.
