The petitioner seeks bail in Rajauli Police Station Case No. 147 of 2017, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Considering the submission made on behalf of the petitioner that recovery of 15 litres of Mahua wine from the house of the petitioner owned by the joint family is the basis for registration of the first information report, this application is allowed.

Let the petitioner, Nand Kishore Chaudhary @ Luterwa, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of the learned A.D.J.-II-cum-Special

Patna High Court Cr.Misc. No.66731 of 2018(2) dt.03-12-2018 2/2 Judge, Nawada in Rajauli Police Station Case No. 147 of 2017. It is, however, indicated in the background of the fact that the petitioner has criminal antecedents of being accused in another case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is indicated that if the petitioner is found to be indulging in similar activities in future, the prosecution shall be at liberty to approach this Court for cancellation of bail granted by the present order.
