JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-08-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The petitioner, who is aged about 55 years, seeks a direction upon the respondents to engage the petitioner on daily wages as a forest labourer to do the work in Piparghati park. It is further prayed that the services of the petitioner may be regularised after condoning the age limit.

At the outset, the learned counsel for the petitioner, Shri Ram Hriday Prasad, submits that at least the petitioner be permitted to do the work as a daily wager and for that purpose the petitioner would be filing representation before the Divisional Forest Officer, Gaya Forest Division, Gaya, hence appropriate directions be issued to the respondent No. 3. The learned counsel for the respondent State, Shri Durjati Kumar Prasad, G.P. 14 has got no objection, if the petitioner files appropriate representation.

Accordingly, the present writ petition stands disposed of with liberty to the petitioner to file appropriate representation before the respondent no.3 i.e. the Divisional Forest Officer, Gaya Forest Division, Gaya for redressal of his aforesaid grievances. It is directed that in case a representation is filed by the petitioner within a period of four weeks from today, the respondent no.3 shall consider the same sympathetically and pass a reasoned and a speaking order in accordance with law within a period of eight weeks, thereafter.
