JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sarsi P.S. Case No. 15 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 384, 504, 506 of the Indian Penal Code.

Allegedly, petitioners and others forcibly took possession of lands of the informant and when informant made protest, they demanded extortion money and also snatched the belongings of the informant.

However, learned counsel appearing for the petitioners submits that there was land dispute between the

Patna High Court Cr.Misc. No.64188 of 2018(2) dt.12-12-2018 2/2 parties and much prior to institution of the present case, father of petitioner no. 2 had lodged a Sanha against the informant and others in respect of the land dispute as the informant and his associates wanted to take forceful possession of lands of the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners do not have any criminal antecedent, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in Sarsi P.S. Case No. 15 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) shahzad/- U T
