JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. 542 C of 2018 registered for the offences punishable under Sections 354-B, 447, 323/34 of the Indian Penal Code.

Petitioner no. 1 happens to be Dewar whereas petitioner no. 2 and 3 are nephews of the complainant. The aforesaid petitioners have been summoned to face trial for the offences punishable under Sections 354-B, 447, 323/34 of the I.P.C. However, the contents of complaint petition go to show that there was land dispute between the complainant as well as

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Manish Kumar, learned J.M. 1st Class, Jamui in Complaint Case No. 542 C of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
