The petitioner seeks bail in a case instituted for the offences under Sections 302, 323, 341, 504 and 34 of the Indian Penal Code.

The prosecution case in short is that on a trivial issue, the accused persons assaulted the husband of the informant due to which he sustained injury and later succumbed to injury. It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.12.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. No allegation of assault is alleged against the petitioner. Patna High Court CR. MISC. No.50768 of 2019(3) dt.19-11-2019 2/2 hemorrhage. The deceased is said to have died in course of treatment after a period of one month. As per the post-mortem report, the death is due to pneumonia.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Pipra P.S.
