JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379 of the Indian Penal Code and Section 135 of the Electricity Act.

The accusation is abusing and pressing the neck of the informant since the informant being Junior Electrical Engineer earlier filed a case of theft of electricity energy against the petitioner.

It is submitted by learned counsel for the petitioner that since a petition was filed against the informant hence in the retaliation the raid was laid in the premises of the petitioner on 23.02.2015 but ultimately the F.I.R of Garhpura P.S. Case No. 10 of 2015 under Sections 323, 341, 379 of the

Patna High Court Cr.Misc. No.27290 of 2015 (2) dt.28-07-2015 2/2 I.P.C was registered on 04.03.2015. Moreover no injury was caused to the informant. A statement to that effect has been made in para 8 of the petition. It is further submitted that petitioner is accused in one other case lodged by the informant himself.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Garhpura P.S. Case No. 30 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
