JUSTICE BIRENDRA KUMAR ORAL ORDER 07-12-2016 Heard the learned counsel for the petitioner, the State and the Union of India.
This is a petition for grant of regular bail for offence under Sections 272, 273 and 34 of the Indian Penal Code and 47(a) of the Bihar Excise Act, 2016.
Nine liters of country made liquor was recovered from the possession of two accused person, including the petitioner. The petitioner is in custody since 29.07.2016. The petitioner has stated on oath that he has got no criminal antecedent.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Adapur P.S. Case No. 119 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Raxaul at Motiharu, East Champaran, or successor Court.
