The petitioner seeks bail in Saran Mahila P.S. Case No. 35/2018, instituted for the offences under Sections 341, 323, 498A, 504, 313/34 of the Indian Penal Code read with Sections 3⁄4 of D.P. Act.
Petitioner is the husband of informant. It is alleged in the written report that the petitioner on the direction of other accused persons assaulted the informant with leg and fists on her stomach causing miscarriage of one month.
Learned counsel for the petitioner has submitted that the occurrence is said to have taken place on 01.06.2018 and F.I.R. has been lodged 09.08.2018. There is no injury report of the
Patna High Court Cr.Misc. No.63819 of 2018 (2) dt.25-10-2018 2/2 informant. It is further submitted that petitioner is in custody since 22.08.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Saran Mahila P.S. Case No. 35/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
