Petitioner is languishing in custody since 03.07.2016 in connection with Kartaha P.S. Case No. 40 of 2016 for the offences punishable under Sections 420/467/471/120B and other minor sections of the Indian Penal Code and Sections 25(1b)A/26/35 of the Arms Act. Only a cartridge was allegedly recovered from the possession of the petitioner.

The petitioner has stated on oath that he has got no criminal antecedent. Further submission is that similarly situated co-accused Nikhil Mishra and Suchindra Kumar have already been granted bail by another Bench of this Court.

No.52222 of 2016 (2) dt.07-12-2016 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Vaishali, Hajipur, in connection with Kartaha P.S. Case No. 40 of 2016.
