The petitioner is in custody in connection with Excise Case No.388 of 2019 for the offences under Sections 56(Kha) of Bihar Prohibition and Excise Act and Section 2(e), 3, 5 & 13 of Mahuwa Flower Rule, 2006.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 02.07.2019. He further submits that in the instant case 40 Kg. Mahuwa Flower was seized but nothing was recovered from the conscious possession of the petitioner and he has no concern with the seized Mahuwa Flower.

Considering the fact that petitioner has no criminal

No.49704 of 2019(2) dt.09-08-2019 2/2 antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Special Excise Judge, Gaya in connection with Excise Case No.388 of 2019.
