The petitioner apprehends his arrest in connection with Complaint Case No.1717/2021, registered for the offences punishable under Section 406 of the Indian Penal Code and Section 138 of the N.I. Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the fact of the matter is that the petitioner took loan of Rs.50,000/- from the complainant for marriage of his daughter and returned only Rs.18,000/- and gave a blank cheque to the complainant. It is submitted that the complainant filled up

No.52398 of 2022(2) dt.14-12-2022 2/2 the rest amount in the said cheque and presented before the bank and the said cheque bounced due to insufficient balance, therefore, the complainant has filed complaint case against the petitioner in the learned court below and the learned court below took cognizance against the petitioner.
Learned APP for the State as well as learned counsel for the complainant opposed the prayer for anticipatory bail of the petitioner.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class (N.I. Act), Motihari, East Champaran in connection with Complaint Case No.1717 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
