JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-304B, 201/34 of the Indian Penal Code. Petitioner happens to be husband of the deceased and it appears from the report of learned court below that the charge has already been framed and out of 7 prosecution witnesses, two witnesses have already been examined.

Therefore, in my view, it is not proper stage to release the petitioner on bail. Hence, his prayer for bail in connection with Agiaon (Garhani) P.S. Case No. 13 of 2015 stands rejected. However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible,

Patna High Court Cr.Misc. No.40444 of 2016 (3) dt.22-11-2016 2/2 preferably, within three months from the date of receipt/production of copy of this order, failing which, the petitioner may renew his prayer for bail before the learned trial court itself.
